Effective Date: September 3, 2026
SuperGood is operated by Simple AG, LLC and its affiliated licensed cannabis dispensaries (together, “SuperGood,” “we,” “us,” or “our”). We operate licensed adult-use cannabis dispensaries in Illinois, Michigan, and Ohio.
This Privacy Statement explains how we collect, use, share, and protect personal information when you interact with us through our website at SuperGoodStore.com, our mobile application (“Supergood Cannabis Store”), our online ordering and reservation services, our loyalty and rewards program, and our in-store retail services (collectively, the “Services”). It also explains the choices you have regarding your personal information.
We provide our Services using technology supplied by third-party vendors, including Dutchie. When you use those features, the vendor processes information on our behalf and under our instructions. This Privacy Statement describes our own practices as the business responsible for your personal information. It does not govern the independent practices of Dutchie or any other third party. See “How the Dutchie Platform Works and Our Service Providers” below.
Please read this Privacy Statement carefully. By using the Services, you acknowledge the practices described here.
1. Who We Are and Scope of This Statement
SuperGood operates retail cannabis dispensaries only. We do not cultivate, manufacture, or distribute cannabis at wholesale. This Privacy Statement applies to personal information we collect from customers, website visitors, app users, and prospective customers through the Services. It does not apply to information handled by our employees or job applicants in that capacity, or to information collected by third parties that operate their own services.
Our Services are intended only for individuals who are at least 21 years of age. See “Age Restriction and Children’s Privacy” below.
2. Information We Collect
The personal information we collect depends on how you interact with us. We collect the following categories:
Information you provide to us. We collect information you give us directly, such as when you create an account, place an order or reservation, join our loyalty program, sign up for communications, or contact us. This may include your:
- Name;
- Email address;
- Telephone number;
- Date of birth and age-verification information;
- Account and profile information, including username and password;
- Pickup and order details;
- Order and purchase history;
- Loyalty or rewards account information;
- Communications you send us, including customer-service messages; and
- Preferences and any other information you choose to provide.
Age and identity verification information. Because cannabis is a regulated product, we are required by state law to verify that every customer is at least 21 years of age before entry and before any sale. At our dispensaries and through our Services, we or our service providers review or electronically scan your valid, government-issued photo identification to confirm your age and the validity of your identification. We collect and use identification information only as permitted by the cannabis laws of the state in which you transact, and we do not retain, use, share, or disclose that information for any purpose not authorized by those laws. We do not collect or use biometric identifiers (such as facial-geometry or fingerprint data) for age verification or any other purpose.
Transaction and order information. When you browse products, place an order or reservation, participate in a promotion, or use loyalty features, we collect information about that activity, including products viewed, products ordered, order history, store location, discounts and rewards applied, quantities, and transaction amounts. As required by state cannabis regulators, records of each sales transaction are recorded in the applicable state’s inventory-tracking and point-of-sale systems.
Payment information. Payment transactions are processed by third-party payment and technology providers. We do not receive or store complete payment-card numbers or full banking credentials; our providers typically transmit to us only a tokenized reference and limited transaction details.
Device and technical information. When you use our website or mobile application, we and our service providers may automatically collect information such as your device type, operating system, application version, IP address, device identifiers, browser type and settings, application interactions, diagnostic and crash data, and usage and performance data.
Location information. If you enable a location-based feature of our application, we access location information only in accordance with the permissions you grant through your device. You can control location permissions through your device settings. Some location-based features may not work if location access is disabled. We may also infer your general location (such as your city or region) from your IP address to show you the correct store and menu.
Information from cookies and similar technologies. We and our providers use cookies, software development kits, pixels, local storage, and similar technologies. See “Cookies and Tracking Technologies” below.
Information from third parties. We may receive information about you from service providers that operate our Services (including Dutchie), from payment processors, from advertising and analytics providers, and from other sources such as loyalty or marketing partners.
3. How We Use Personal Information
We use personal information to:
- Create, manage, and secure your account;
- Verify your age and eligibility as required by law;
- Process and fulfill your orders and reservations, including pickup;
- Operate our loyalty and rewards program;
- Provide customer support and respond to your requests;
- Communicate with you about your orders, account, and transactions;
- Send you promotional communications where permitted, from which you may opt out;
- Send push notifications if you have enabled them;
- Personalize and improve your experience and our product offerings;
- Analyze usage and measure the performance of our Services;
- Maintain the security and integrity of our Services and prevent fraud, abuse, and unauthorized activity;
- Troubleshoot and improve our Services; and
- Comply with applicable legal, tax, and regulatory obligations, including cannabis recordkeeping and reporting requirements.
We do not use age- or identity-verification information obtained at the point of sale for marketing or for any purpose beyond what the applicable state cannabis laws permit.
4. How the Dutchie Platform Works and Our Service Providers
We use third-party technology and service providers to operate parts of our Services. Our online menu, ordering and reservation features, mobile application, and point-of-sale system are powered by Dutchie (Courier Plus, Inc. and its affiliates).
When you place an order, make a reservation, or otherwise interact with a SuperGood menu or feature powered by Dutchie, Dutchie processes your personal information on our behalf and at our direction, as our service provider, to deliver those features to you. In that role, Dutchie is contractually restricted to using your information for the purpose of providing services to us. SuperGood — not Dutchie — is the business responsible for the personal information collected through these features and for responding to your privacy requests relating to that information, as described in “Your Privacy Choices and Rights” below.
Dutchie may also collect and use certain information as its own independent controller — for example, when you visit Dutchie’s own websites or marketplace, or when Dutchie conducts its own marketing or analytics. Those independent activities are governed by Dutchie’s own privacy policy, available at https://dutchie.com/privacy, and not by this Privacy Statement.
As part of the menus powered by Dutchie, you may see sponsored content and personalized product recommendations based on your browsing and interactions within those menus. This activity may constitute “sharing” of personal information for cross-context behavioral advertising or “targeted advertising” under some state laws. See “Sales, Sharing, and Targeted Advertising” below for your choices.
We also use other service providers for functions such as website and application hosting, analytics, communications and customer engagement, payment processing, security, and technical support. We require our service providers by contract to protect personal information and to use it only to provide services to us.
5. How We Share Personal Information
We do not sell your personal information for money. We may share personal information in the following circumstances:
- With service providers and technology vendors (including Dutchie) that operate our Services on our behalf, subject to contractual confidentiality and use restrictions;
- With payment processors as necessary to complete your transactions;
- With state cannabis regulators and inventory-tracking systems as required to record transactions and comply with cannabis laws;
- With government authorities, courts, or other parties when required to comply with applicable laws, regulations, subpoenas, court orders, or legal process;
- With professional advisers such as auditors, lawyers, and accountants, where appropriate;
- To protect the rights, property, or safety of SuperGood, our customers, our employees, or others, and to prevent fraud or unauthorized activity; and
- In connection with a business transaction such as a merger, acquisition, financing, reorganization, or sale of assets, or during due diligence for any such transaction.
6. Sales, Sharing, and Targeted Advertising
We do not sell your personal information in exchange for money. As described above, the personalized recommendations and sponsored content shown in our Dutchie-powered menus may involve the use of tracking technologies that could be considered “sharing” for cross-context behavioral advertising or “targeted advertising” under certain state laws.
You may opt out of this activity through the preference controls made available in our Services or by contacting us using the information in “Contact Us.” Where required by law, we honor the Global Privacy Control (GPC) signal as a valid opt-out request. If you opt out, you may still see sponsored content, but it will not be personalized based on your browsing activity.
7. Cookies and Tracking Technologies
Our website and digital Services use cookies, software development kits, pixels, local storage, and similar technologies to operate features, remember your preferences, understand how our Services are used, measure and improve performance, and support the personalization and advertising features described above.
You can set your browser to refuse some or all cookies or to alert you when cookies are being set. If you disable cookies, some features of our Services may not function properly. Because there is no common industry standard for interpreting “Do Not Track” browser signals, our Services may not respond to all such signals; however, we honor the Global Privacy Control signal where required by law.
8. Data Retention
We retain personal information for as long as reasonably necessary to provide the Services, operate our business, maintain transaction records, comply with our legal, tax, and cannabis-regulatory obligations, resolve disputes, and enforce our agreements. Cannabis laws in the states where we operate require us to maintain certain transaction and inventory records for defined periods. When personal information is no longer needed for these purposes, we will delete, destroy, or deidentify it. Retention periods vary depending on the type of information and the applicable legal requirements.
9. Data Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect personal information from loss, misuse, and unauthorized access, disclosure, alteration, or destruction, and we require our service providers to maintain reasonable security measures as well. However, no website, mobile application, electronic storage, or method of transmission is completely secure, and we cannot guarantee absolute security. You are responsible for keeping your account credentials confidential.
10. Your Privacy Choices and Rights
Communication preferences. You may unsubscribe from promotional emails using the unsubscribe link in those messages, and you may adjust push-notification and location permissions through your device settings. Even if you opt out of marketing, we may still contact you about your orders, account, and other administrative matters.
Access, correction, and deletion. You may contact us to request access to, correction of, or deletion of personal information we hold about you, and to update your account information. We will honor these requests as required by applicable law. Some information must be retained where required by law or for legitimate business, security, transaction, tax, or cannabis-regulatory purposes.
Opt out of sharing and targeted advertising. You may opt out of the sharing of personal information for targeted advertising as described in “Sales, Sharing, and Targeted Advertising” above, including through the Global Privacy Control signal where required by law.
To make any request, contact us using the information in “Contact Us.” We may need to verify your identity before responding, and, where the law allows an authorized agent to act on your behalf, we may require proof of that authority.
11. State-Specific Information
We operate in Illinois, Michigan, and Ohio. None of these states currently has a comprehensive consumer data-privacy law in effect. Your information is protected by the generally applicable privacy, data-security, and cannabis laws of these states, and by this Privacy Statement.
Illinois. We handle personal information in accordance with the Illinois cannabis laws that limit the collection and use of purchaser information, the Illinois Personal Information Protection Act, and, to the extent applicable, the Illinois Biometric Information Privacy Act. As noted above, we do not collect biometric identifiers. If a security breach affecting your personal information occurs, we will notify you as required by Illinois law.
Michigan and Ohio. We handle personal information in accordance with Michigan and Ohio cannabis laws, which limit the customer information a dispensary collects and require us to protect the confidentiality of customer records. If a security breach affecting your personal information occurs, we will notify you as required by Michigan or Ohio law, as applicable.
12. Age Restriction and Children’s Privacy
Our Services are intended only for individuals who are at least 21 years of age, consistent with the adult-use cannabis laws of Illinois, Michigan, and Ohio. Our Services are not directed to children, and we do not knowingly collect personal information from anyone under 18 years of age. If we learn that we have collected personal information from a person under 18 without appropriate authorization, we will delete it. Using our website or application does not eliminate any age, identification, eligibility, purchase, or possession requirements imposed by applicable law.
13. Third-Party Websites and Services
Our Services may contain links to, or integrations with, third-party websites, platforms, or services that we do not operate or control, including Dutchie and social-media platforms. Those third parties maintain their own privacy policies and practices, and we are not responsible for how they handle your information. We encourage you to review the privacy policies of any third-party service you use.
14. Changes to This Privacy Statement
We may update this Privacy Statement from time to time to reflect changes to our Services, technology, business practices, or legal requirements. When we do, we will revise the “Effective Date” above and post the updated version. We encourage you to review this Privacy Statement periodically.
